Fatwa Back At You (Corrected)

Further evidence of the depths to which some in Pakistan have sunk. This is a short video of the Murtid Qadri being presented in court yesterday, charged with the murder of Punjab Governor Salmaan Taseer, where he was lauded by some lunatic lawyers, showered with rose petals, garlanded and even kissed. This is an account of his presentation in court today from the Express Tribune, where the lunatics once again greeted him. In addition to the lunatic lawyers, most religious fitna parties have refused to condemn Taseer's murder, with many going out of their way to praise the "valour" of the deranged criminal. They include the so-called "sufism-inspired", "moderate" Barelvi parties (Qadri is from the Barelvi sect) who in fact have been at the forefront of defending the murder.

Many in the media seem also to be hemming and hawing, refusing even to attach the word "shaheed" [martyr] to Taseer (whereas they think nothing of attaching it to people dying in accidents and even the Lal Masjid terrorists), apparently buckling to open threats hurled at media houses and anchors by extremists. The height of hypocrisy has come from anchors and talk-show participants, pretending to treat the issue "objectively" by debating the straw-man polarization of the country into 'left' and 'right' extremists. Actually, as Kaalakawaa has pointed out in his excellent post, all they are doing is equating murder with a voicing of opinion and demonstrating their blinkered cowardice. (There have been a few notable exceptions to the general cowardice on the electronic media in this case and it is only fair to also point these out: Iftikhar Ahmed (Geo's Jawabdeyh host as a panelist on Dunya TV), Kamran Khan (on Geo), Mosharraf Zaidi (as an independent analyst on Dunya), Moeed Pirzada (on Dunya), Najam Sethi (on Dunya), Arshad Sharif (on Dawn News), Rauf Klasra (as a panelist on Dawn News) and Sana Bucha (on Geo) - of the ones I watched - did not try to hedge their bets.)

But perhaps worst of all, most mainstream 'secular' political parties, including the Taseer's Pakistan Peoples Party (PPP), have been at best mealy-mouthed about their condemnations. In fact, the PPP has shown remarkable pusillanimity and short-sightedness by refusing to take on the issue of religious extremism head-on and instead claiming a political conspiracy behind Taseer's murder, basically attemting point-scoring against the PML(N) Punjab government. The PML(N) government does indeed have a lot to answer for (since Qadri's Elite Force came under its jurisdiction) but surely the greater issue is of the mindset that has been allowed to be cultivated in this country. The party's official stance - as articulated by the closet rightist law minister Babar Awan and the blundering interior minister Rehman Malik (who boasted he would shoot a blasphemer himself as if to prove his piety credentials) - has been nothing short of abominable. This at a time when even conservatives such as Pakistan Muslim League (Q)'s Chaudhry Shujaat Hussain are willing to concede - in the face of growing civil society outrage - that steps do need to be taken to stop the misuse of religion by the lunatics.

The Let Us Build Pakistan blog has published a fatwa (religious decree) by Mufti Idris Usmani against not only Qadri but also those who support him in word or deed. Normally, I would never post a fatwa on here because I believe them to be largely irrelevant to today's world and usually absurd. But as I pointed out in an earlier post, it's about time these lunatics got a taste of their own medicine.




"Shaykh-ul-Islam Hazrat Mufti Muhammad Idris Usmani of Jamia Islamia has issued the following fatwa about the killer of Governor Punjab (Pakistan) Salman Taseer and about those who are praising and justifying his murder.
Question:
What do the Ulema say about the murder of Governor of Punjab (Pakistan) Salman Taseer who was killed by his own security guard. The guard claimed that he killed Salman Taseer because he was blasphemous to the Prophet (peace by upon him). However, there is no evidence of Salman Taseer’s blasphemy to the Prophet (pbuh). What do the Ulema say about many people who are praising Salman Taseer’s killer?
Answer:
“In the Name of the Merciful and Compassionate Allah, Dar al-Fatwa. Praise be to Allah, the Lord of the Universe; blessings and peace be upon our Master Muhammad, the Apostle of Allah, and upon his Family, his Companions, his Followers and those who have found the way through him.
I have carefully read the whole issue and also read various news reports and articles related to this (issue). I have also spoken to the jayyad ulema (eminent scholars) in Pakistan and India.
In the light of the available evidence, I state the following:
1. Malik Mumtaz Qadri has committed gunah-e-azeem (great sin) by killing an innocent soul. By taking law into his own hand, by killing an innocent man, and by bringing disgrace to the name of Islam, Malik Mumtaz Qadri has created fasad fil arz (mischief on earth) and committed tauheen-e-risalat (blasphemy to the Prophet). Same applies to those who are creating further mischief (fasad) by praising or justifying this heinous crime in the name of Islam. The killer of Salman Taseer is a real blasphemer to Islam and the holy Prophet (peace be upon him).
2. Those individuals and groups including the ignorant ulema, misguided journalists, politicians, lawyers wa deegar (etc), who are celebrating or justifying in any manner this heinous crime must be treated as accomplice in this crime. Those who endorsed a fatwa of Salman Taseer’s murder too must be treated as mufsid fil arz and must be punished according to the Shariah.
3. While the state of Pakistan will pursue a legal case against the killer and his abettors according to their national laws, the following verses from the Quran clearly specify the punishment for Malik Mumtaz Qadri and his supporters and cheerers.
This is a case of fasad fil arz. The perpetrators of such acts should be punished as provided in Sura Maida of the Quran (Ayah 32 and 33).
32. We ordained for the Children of Israel that if anyone slew a person―unless it be for murder or for spreading mischief in the land― it would be as if he slew the whole people: and if anyone saved a life it would be as if he saved the life of the whole people. Then although there came to them Our Messengers with clear Signs, yet even after that many of them continued to commit excesses in the land.
33. The punishment of those who wage war against Allah and His Messenger, and strive with might and main for mischief through the land is: execution, or crucifixion or the cutting off of hands and feet from opposite sides, or exile from the land: that is their disgrace in this world, and a heavy punishment is theirs in the Hereafter.
According to Islamic Shariah, Malik Mumtaz Qadri, any one supporting or praising his act must be executed by law or crucified or their hands and feet cut off from opposite side. Exile is not needed in the present case as the State can exercise Shariah authority on its citizens and subjects.
Those who are praising a killer and a mufsid want to go to Hell of their own accord.
For others, we can only pray for their path of righteousness.
In the light of religious commands, in the light of religious rules known to us, I think that these people should renew their faith and renew their marriages. But no one can remove anyone’s obstinacy. I pray to Allah to enable all Muslims, through His Prophet, pbuh, to be steadfast to His religion, Islam. Ameen!

Here's an idea. Register blasphemy cases against all these fitna leaders and lawyers. Clog up the courts with blasphemy cases and let's see how the pious Federal Shariat Court and the enlightened Supreme Court deal with it.

We have been made aware that the above mentioned alleged fatwa posted on the LUBP blog is fake. And while I personally may still subscribe to the notion that religious lunatics need to be dealt with strongly, as a blog we cannot allow fabricated propaganda to damage our credibility. We really should have been more skeptical of the source and while we did link to the original, we should have qualified ourselves better. The inclusion of the made-up fatwa also marginalizes the rest of the post, by which we stand. Apologies to all our readers. A separate clarification will also be posted. Needless to say, we will look upon any future information posted by the LUBP blog with a far more skeptical eye.

Long time reader, first time commenter. Let's just say, things have changed so badly in the last few days, I felt compelled to write something, anything.

Regarding the entire scenario, and every wrong thing that happened in my country before the governor's shahadat (yes, he is a shaheed).. I had always kept my comments and my thoughts to myself. But not any more.

The situation in my country doesn't anger me, or frustrate me. I've had enough of those to learn to live with them. Instead, it now saddens me.

Today as I read this post, I felt like very silently crying .. out of happiness. Happiness that maybe ..somewhere, there are people possessing ilm-e-deen who came forward and condemned the act in a PROPER manner i.e. by issuing it as a fatwa. Maybe there is hope somewhere out there.. maybe there is hope after all

Apparently Zaid Hamid has also been sharing his "opinions" on what has happened. The irony is that isnt he himself got some cases filed against him for denying the finality of the Holy Prophet? On the other hand we have Imran Khan who tried his level best to link US policy to what happened. Everyone is extracting as much mileage out of this tragedy as possible before our notoriously short memories kick in.

And anyway, remember how in 2009 Liaqat's show on Geo insigated the killing of two Ahmediyyas in Lhr?

And yes, I agree. the handful of TV persons you mentioned did a comendable job, and I'm glad this tragedy has finally taken even ppl like Mosharrif Zaidi out of their La La Lands where they sounded more like a more intelligent versions of idiots like Imran Khan and Fatty Bhutto.

Isn't the Ameer of Barelvi Jammat Ahl e Sunnat Pakistan Prof. Syed Mazhar Shah Kazmi the elder brother of Hamid Saeed Kazmi? These people vote PPP and therefore it could be one of the reasons the PPP is trying to bury this.

why are you so worried about salman tasser doesn't the 2k people who were killed by drone attacks last year had same rights to live as salman taseer ?

as per article 62/63 of the constitution tasser had no right to hold office of the governor but as our courts and govt are unable to exercise their laws on the powerful so to uphold the constitution qaqrdi had to take law in his own hands

and thanks to qadri for once salman taseer would have also realized that how everyday feels like for a common man who lives under the jangle ka qanoon aka might is right .. the way qardi chose might not be the ideal way but right now seems to be the only way left to teach a lesson to the corrupt elite of the country

why was salman taseer so worried about the poor asia ? was there any dearth of prisoners languishing in our jails under false and made-up charges ? why didn't he raise his voice for ALL of them .. why he singled out asia ?

and what right salman tasser had to say that he will get asia free... why didn't he let the law take it course ? there is a process in place, the course was going to high court than supereme court and even after that president had powers to forgive ... you liberal hypocrites tell me that isn't the law of the land to be followed? why salman tired to influence the case proceedings and tired to go out of the way to do favors for asia ? he had no right to do so and was acting in a unlawful manner

so just as with asia's case salman took the law in his hand so qadri also took the law in his hand ... fair and square ... as you sow .. so shall you reap

Do you want to know why western media do not comment much about this? A strangeness has pervaded news from pakistan. This strangeness has to do with standards of humane behaviour. At least in Egypt at the bombing of the church of the copts there were enough muslim egyptians who protested along the christians.
In Pakistan however we see a murderer showered in rose petals. Get real, will you!

I may be the first person to point this out on the internet, but fatwa, in all likelihood, is fake, for the following reasons:

1- There is no copy of the original Urdu fatwa.

2- Quick search on internet proves there's no search person as Idrees Usmani prior to this fatwa

3- Shaikh ul islam of pakistan is Rafi Usmani. His two brothers are Taqi usmani and wali razi

4- the only madrassah that goes by name of Darul Ifta is in India, and it is not called Jamia islamia. Actually, Jamia islamia is a very very vague to use for a madrassah.

5- the language and terms used are not fatwa-type

6- there is no primary source

7- criticalppp had every incentive to do this...

Taseer advocated protecting a poor woman unfairly put in prison with absolutely no evidence because of a warped law and a joke of junior judicial system and for this he deserved to be killed??? (Advocates of the "law" taking its course conveniently skip over the fact that it would probably take years of her languishing in prison for her case to be heard, while not one of them would be willing to allow her bail which was her due right while the case proceeded or in fact take the guarantee of protecting her life in the face of naked threats from extremists.) Ghamidi is simply too good for these mullahs. Ghamidi argued that most Pakistanis follow the Hanafi sect and Imam Abu Hanifa declared that a NON-MUSLIM CANNOT BE KILLED FOR BLASPHEMY.

It gives an idea of the level of intelligence of a traditional mullah.

I think we are going towards the separation of church & government. remember witch hunt in Europe between 1400 to 1700. almost 100,000 executions, that were catalyst for separation of church & government..

After seeing the state of society in Pakistan the one thing that requires to be debated greatly is the "Two Nation Theory and Jinnah". There is no doubt in my mind about MA Jinnah's personal integrity, it was of highest order, but was he a statesman? Was he a visionary? I doubt that.
I still see these debates not emerging in the Pakistani society. To seek truth one needs to challenge his own first.

If you think that ghamdi is so right and expert on Islamic law than why doesn't he challenge the blasphemy law in federal sharia court ? the court does not consist of jihadis or the average illiterate moulvi. it is made-up of learned people who have spent their lives studying Quran and Sunnah
ghamdi and you have the opportunity to prove the point so why wait ? so ahead and show the world the the law is wrong and against and Islam


similar opportunity was also given to qadiyanis to prove their point before the parliament and they failed to prove their stance and hence were declared non-muslims, however till this day they continue to moan and cry that they have been 'unfairly' labeled non-muslims, they also try to portray themselves as champions of democracy and liberalism but forget that it from the same democratic process that they have been thrown out of the fold of the Islam and should now put up with the will of the people and parliament

similarly when there is matter of sharia or law you should consult with relevant person or should avoid spitting out crap, I wonder WHY salman tasser who was a known drinker, immoral person, had kids out of wedlock, had relations with a sikh women and always took pride in his liberal outlook had to put his leg in blasphemy law and its relevance w.r.t Islam? when you are far apart from Islam than what right do you have to comment and say if something is as per Islam or not?

were you present at the court proceeding have you followed the case hearings? how do you know that here was "absolutely no evidence" ? have you thoroughly examined the case and all the evidence attached to it?

the court examines evidence and case and awards decisions according to the law of Pakistan, you have no right to doubt on the integrity of a judge or court just because you don't agree with the decision, if you have some evidence or claim to show that decision is wrong than place it here but don't make wild assertions

and even if we assume that the decision was wrong than what right slaman tasser had to make comments like "I will free asia" etc
imagine that a court in California awards a decision and the Governor says that he will ensure that the accused does not serve the sentence,
I am sure the governor would we impeached and thrown out of the office for trying to influence and hinder the judicial process but here in Pakistan we have people like you ,,, the so called civil society .. who turned a blind eye to the illegal acts of salman tasser and in fact are praising his unlawful actions and acts of influencing the legal proceedings .. no wonder pakistan is in so sorry state of affairs because the people who claim to be the champions of the 'rule of law' are also the ones who actively promote the mocking of laws for their own vested interests

1. Salmaan Taseer's arrogance towards the religious leaders. He should have called for an open debate instead of insulting them.

Its the traditional mullahs who cant tolerate a difference of opinion. Traditional sects give fatwas against each other; they need to reform their way of thinking. For me, the concept of "Taqleed" is an insult to human intelligence. Traditional mullahs demand taqleed from their followers, but rationalism from other sects or non-muslims. Their followers shouldnt question their beliefs but others should! I cant live with such contradictions. I believe in reason, give me arguments and i am ready to reconsider my thoughts.

the problem with guys like you is selective justice, you claim everything about slaman taseer murder but you overlook his own unlawful acts which in fact led to the murder, had he not tried to act out of his capacity in an illegal manner he would have been alive today
why are you having a hard time admitting that what salman taseer did was also UNLAWFUL just as what qadri did was UNLAWFUL ?

you mentioned that HOW justice is equally meted out to people in west yet are like a typical hypocrite overlooking the unlawful acts of salman taseer and just want all of the world to concentrate on qadri .. in West they don't let you off the hook just because you are a Governor

so was salman taseer above the law ?

You mentioned the separation of state and religion in the context of Pakista and Islam. I dont see that as the current reality. Firstly, Christianity inherently has separation of church and state as mentioned clearly by Jesus himself. There is no such precedent in the case of Islam. Which had a very political identity since its ver inception. Secondly, europe was passing through an intellectual renaissance, which clearly not seems to be a case in Pakistan.
